PRO Act Support in the Senate On Hold

Senators Mark Warner, Kyrsten Sinema, and Mark Kelly are the only three Democrats preventing the House passed Protecting the Right to Organize (PRO) Act from coming to the Senate floor for a vote.

Passage of the PRO Act remains a top priority for the Biden administration and Congressional Democrats. The bill would dramatically alter U.S. labor law. If passed, the legislation would annul right to work protections in 27 states, require employers to hand over workers’ private information to union organizers, rewrite the standards used to determine when two companies are considered “joint employers”, eliminate the private ballot, and change the standards used to classify workers as employees and independent contractors.

Senate Majority Leader Chuck Schumer promised AFL-CIO head Richard Trumka that he would bring the legislation to the Senate floor for a vote with 50 co-sponsors, but the three Democratic Senators remain concerned about some of the measures in the bill. Senator Warner recently stated that although he supports many elements of the PRO Act, he had concerns about the “election voting process for a union” and the codification of the ABC test in the National Labor Relation Act.

Even with the support of these three Democratic Senators, the bill is unlikely to pass the Senate with the filibuster in place. No Republican Senator has cosponsored the legislation to date.
