IWLA and Allies Send Letter to EEOC Regarding Employee Vaccine Incentives

As a member of a coalition representing employers of all sizes, IWLA sent a letter to the Equal Employment Opportunity Commission (EEOC) Chair Charlotte Burrows on February 1, requesting official guidance to clarify the extent to which employers may offer employees incentives to vaccinate.

While many employers want to provide incentives to help expedite and facilitate the vaccination effort, there is some uncertainty surrounding potential violations of the Americans With Disabilities Act and other laws enforced by the EEOC. IWLA is hopeful that the EEOC will shortly issue broad, clear, and useful guidance on what qualifies as a permissible incentive to encourage employees to get vaccinated, as a means to help employers resolve current concerns related to liability.
